Item Description: | The paper deals with the regulae iuris (principles of law), with the role of Roman jurists in the classical period of Roman law and with the methodology of their legal work. By using the so-called perplexing cases of Roman law from the work of G. W. Leibniz, the author proves that the way, of how to resolve situations where opposing theses are equally sustainable, is to amend the positive law with the natural law. The principle of law may therefore have an influence on the solution of a legal case as an algorithm for a just decision. |
