Popis jednotky: | The article deals with the institute of general average in Roman law and modern legal regulation. In: Roman law, the institute is regulated by the Lex Rhodia de iactu (Dig. 14, 2) – an example of the reception of Greek law into Roman law. The article describes the basic principles of the Lex Rhodia de iactu concerned with the issue of general average and the influence of the solutions based on these principles on the Law of Pandects (Pandektenrecht). Finally, in its concluding parts, the article discusses the so-called ‘modern’ solution of the issue/problem/question of general average in the private international law and in the Czech legislation. |
